These Terms of Use ("Terms") govern your access to and use of Smplhr ("Website"), a platform that connects candidates with companies who subscribe with our services. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to all of these Terms, you are not authorized to use the Website.

When you register as a candidate on the Website, we collect the following information:

- Email Address
- LinkedIn Profile Link (Optional)
- Resume
- Create your candidate profile and connect you with relevant job opportunities.
- Send you job alerts and other communications related to your job search.
- Verify your identity and contact you for additional information.
- Improve the Website and our services.

- Video Interview
You (company or client or second party) are prohibited from:
- Sharing candidate data with any third party without their prior written consent.
- Using candidate data for any purpose other than identifying and contacting potential candidates.
- Engaging in any discriminatory or harassing behavior towards candidates.
- Downloading, storing, or copying candidate data in any way that violates applicable data protection laws.
You as company or client or second party are responsible for complying with all applicable data protection laws and regulations regarding your use of candidate data.
You as candidate may be invited to record a video interview as part of your application process. These video interviews will be published on our dashboard and accessible to our clients. By participating in a video interview, you agree to the following:
- You grant us a non-exclusive, irrevocable, royalty-free license to use, reproduce, modify, publish, and distribute your video interview for the purpose of connecting you with potential employers.
- You understand that your video interview may be viewed by various entities, including potential employers, their representatives, and other users of the Website.
- You are solely responsible for the content of your video interview and any information you disclose therein.
Disclaimers and Warranties
WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, ABOUT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF THE CONTENT OR SERVICES PROVIDED ON THE WEBSITE.THE WEBSITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.Limitation of Liability
WE WILL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
You as candidate and company will not, directly or indirectly, use the Platform or any Smphr services for any unlawful, improper, or unethical purpose, including, without limitation. You as candidate and company agree that Your use of the Platform will comply with all applicable laws.
Violations and Consequences
If you violate these Terms or engage in any behavior we reasonably consider harmful or inappropriate, we may suspend or permanently terminate your access to the Platform without liability. We also reserve the right to suspend, disable, or delete your account - in whole or in part - if you breach these Terms, any other agreements with us, or if your actions or content harm our reputation or goodwill.
If your account is removed for these reasons, you will not be allowed to re-register for our services. We may also block your email and IP address to prevent future access.
Recruit – Talent Search and Job Posting
Smplhr provides a platform that facilitates job matching and talent discovery. However, we are not a party to any contracts between clients (employers) and contractors or employees.
Smplhr focuses solely on job matching and is not responsible for the outcomes of engagements beyond this scope.
Clients are fully responsible for their own hiring decisions and must verify candidate qualifications independently.
Similarly, candidates are encouraged to verify the reputation and legitimacy of any organization they engage with.
Smplhr reserves the right to suspend or terminate any account engaged in fraudulent, unethical, or non-compliant behavior.
Clients using Smplhr’s platform agree to:
Pay contractors or employees according to agreed terms.
Handle and resolve any disputes directly with the contractor or employee.
Accept account suspension for unethical practices, including but not limited to non-payment.
Smplhr is not liable for any disputes related to payment or contract terms between clients and candidates.
Expert Recruiter & Contractor Management
Smplhr offers optional recruiter and contractor management services for clients hiring through the platform.
Clients agree to:
Use escrow services where applicable.
Authorize Smplhr to debit recurring charges automatically.
Allow for contractor termination with notice to limit potential liability.
Accept legal action for any unpaid service fees or outstanding balances.
Smplhr reserves the right to pursue legal recourse for unpaid fees.
Pay - Employer of Record (EOR) Services
Clients using Smplhr's EOR services agree to the following terms:
Prepay monthly payroll and service fees in advance.
Sign an auto-debit authorization for recurring payments.
Allow Smplhr to run credit checks or request bank guarantees where necessary.
Contractors may be terminated with prior notice to minimize liabilities.
Smplhr reserves the right to pursue legal action for non-payment.
In the event of a legal dispute or contract conflict, Smplhr will refer the matter to the relevant laws and may involve the company's designated legal firm.
Intellectual Property
The Website and all content contained therein, including but not limited to text, graphics, logos, images, and software, are the property of PT AHLI KARYA IMPROOVI TEKNOLOGI or its licensors and are protected by copyright, trademark, and other intellectual property laws.
Entire Agreement
These Terms constitute the entire agreement between you and us with respect to your use of the Website.
